Can somebody mention how long it took to get AP approval at NSC ? I applied for AP at NSC on June 12th and I booked ticket for my wife for Aug 3rd, I was going to join her to India and booked my for October, I figured I would carry both the AP's and use it for coming back, now I am reading that AP has to be approved before she leaves or else it is no good. Can some body put their approval times at AP in recent times, so I can decide to change tickets accordingly ?

I'm trying to schedule my visa stamping date in aug /sept time frame in India. In delhi consulate when I click on Indian resident I see the available dates but when I click on Indian citizen residing in US, I see no availability. I'm not sure which option should I choose. I'm a student working on OPT in US. My OPT will expire on Aug 4th and so I will come to India. I'm not sure which of the two options I have to choose while scheduling an interview :
Resident of India/Bhutan
OR
Indian Citizen residing in United States.
I would really appreciate any help in this matter.

You should choose "Indian Citizen residing in United States". Can you please stop creating multiple threads? You have atleast 3 threads open right now for the same question.

Hi all,
My wife is on F-1 Visa and is planning to graduate in Dec 07. I have applied for I-485 for both of us in last week of July. Can she Under-Enroll for Fall 2007 as that will be her graduating semester?
I understand that once I-485 is filed, the F-1 Visa candidate cannot make any F-1 related changed (transfer, extend, OPT) since that person has shown immigration intent. What about under enrollment in graduating semester? My wife called her school and they said that they have to internally approve her under enrollment by looking at her Plan of Study, graduation application etc.. The approval is given internally and INS is not involved in the approval process. It�s just that after the approval, the school has to inform INS about what they did.
Does it mean, it�s Okay to under enroll? Any inputs on this will be appreciated.

I'm on H1B. Recently I joined new employer and the transfer is still in
pending status.
Among the documents required to sponsor for B2 visa, I'm supposed to
send copies of I-797 and I-94. I have old employers H1B approval notice
and I-94, but not of the new employers. I have the H1B receipt notice
related to the new employer.
Is it fine to sponsor for a B2 visa and for the visitors to attend the visa
interview in the US consulate with all the other essential documents
including new employers H1B receipt notice without the new employer H1B
approval notice.
Any of your valuable suggestions are welcome.

I think this is a step forward...but aint cutting it...your status remains "in process for years"...everyday check the same url and it says gives the same stale status...what we need is a way to make a resonably accurate guess as to when my LC will go into the next stage..

Hi friends,
I planning to change my employer after 180days and I want go for the fulltime by using my EAD because my I-485 will take next 3 or 4 years (PD May-2007). My present H1 is still Oct 2008 (labor and I-140 cleared).
1. What are the chances for rejecting my I-485 file?
2. If my I-485 file rejected after my H1 expired (EAD using) ?
3. How to settle out this ? Do I need to go back india?

I came to US on H4. My H1B got approved when i was in India. But I came through H4 only.
Now i want to change H4 to H1B. If i want to apply for change of status..do i need to go back to india(ot other countries) for stamping? Or can i get H1B staying here?

Currently you are on H4. If you apply for H4 to H1 transfer, you can get H1 and start working from October this year. If you cannot find project immediately, you wait up to 3 months or 6 month (maximum), otherwise change status back to H4 or you will be in trouble. Since economy is not good, it is tough to get projects nowadays, already current H1 holders are looking for projects and some have gone back. if you have already worked in India, then you may get project easily, If you did not work, then it is tough to get a project. When you are on H4, you can have peaceful life while your psouse is working, you can have get togethers whenever you want, you can cook special dishes for your spouse and wait at the door in the evenings.Real problem arises when you become pregnant (assuming you are woman), you need to take a long break if you are working,, especially if you are away from your spouse....so point is have fun with spouse, have get togethers with other couples, go shopping at BedBathandBeyond/walmart/target/jcpenny in discount seasons, have honeymoon trips again n again...Go to India whenever you want.These things are so memorable than struggling to get projects and maintaining status. When you cant maintain status you cannot go to India whenever you want....

If I were you, I would just do a little search in the forum and close this thread. There was an extensive discussion on this very topic for days and the thread had to be eventually closed because it was taking ugly turns. Let's not go that route again. Atty Said ,It is fine to write 6/30/2010;The LCA can be for a longer period of time than that which is requested in the I-129 petition � it just can never be for a shorter period of time.

I just graduated with a Bachelor Degree, and I am currently on H1B. I am so concerned about the 5 year backlog on EB-3, which will take more 10+ years to become a citizen....
I am thinking about getting an online MBA degree from an accredited school ASAP, and ask my employer to promote me to a position that require an MBA, ex. manager. (I think it's not a problem in a small company) Will I be able to get into the EB-2 line?
Have anyone done that before? May you share your experience whether it's successful or not?
As long as your job (for which you are applying for the GC) requires it and you are qualified, you can apply in EB2 category. BTW, the 5 year wait is for ROW and not for over-subscribed countries such as India, China, mexico etc. Hopefully, you are from a ROW category country.
