    Hi,
    I would really appreciate if someone throws some light on this issue. I am a J1 scholar at the University of Pennsylvania. I do not know what category that is because I am not paid either by my sponsor (upenn) or by my own government(India). Now, i wish to get enrolled in a full time MS program of University of Arkansas. In order to do that, should I apply for transfer of J1 from UPenn to U of A ...or should apply of transfer of visa from J1 to F1.In case I apply for F1, can I :
    1. Start my classes till my transfer from j1 to f1 is pending
    2.receive assistantship or on campus employment from UofA till my status from j1 to f1 is pending?

    Two I140 in process with a difference of one years in the priority date (one original and one recently filled substitution with improved PD). Which I-140 should be used for I485. IF PD goes back to retrogration, the substitution would help with a risk of getting reject as well. The original I140 has less risk but if PD goes in retrogration, it might get years to get I-485 approve. Suggestions?

    Hi guys,

    Does anyone know, When to apply for FOIA for I-140 ? After or Before Approval of I-140. Coz I don't know whether my I-140 is approved or not yet.

    Or should we wait until the processing dates cross our reciept dates ?

    Anyone who did this successfully, pls enlighten the members.

    Dear fellow IVians/ Lawers.....

    Please help me

    I am on my H1B 6th Year Ending and my H1B valid till 2012 Sep 30 with my Current employer company A Which is a desi consultancy company.

    I have a approved I140 with company A. With PD of March 2008. I 140approved in OCT2008
    Cargability - India
    I485 - Not yet filed:o
    ----------------------------------------------------------
    on March 1st company A announced that they will be merging with company B.

    Company B Sent us an E-mail saying that they are acquiring resource group of company A.

    :confused::confused:

    When we questioned our old employer company A, they told us that yes company A will remain in existence but all human resources will move to company B :mad: All other assets and liabilities will stay with company A.

    I am in lots of confusion...and questions...heap of troubles it seems...
    Please tell me

    1. This Situation can be called/categorized as Aquisition/Merger?
    2. Will my I140 quilified for Successor of Interest if company B is ready to take over and sponcer GC for me?
    3. Or do I need to go thru the whole process of ADS, PERM, I140 path to come to current state?
    4. What happens if my PDate (Old, and assuming that in either case I can port my PD??) is current before company B's I 140 got approved? Can I file I 485 based on my company A I140 As company A still exists???
    Are there any complications involved in this?

    5. I am assuming that I am qualified to entitile 3 Year H1B visa with company B based on my company A approved I 140. am I correct?

    6. What happens if company A is going for bankruptcy before my H1B transfer?

    7. What happens if company A is going for bankruptcy before my I140 approved with company B and port I140 PD?

    8. also I heard that Company A may required to pay some amount to the employees(20K ??)? Any idea on this?


    Kindly help me!!!

    I just noticed that the I-140 my lawyer submitted 3 months ago to Nebraska has a typo in my DOB (21/07/2978 instead of 21/07/1978). Yes its a thousand years out! A copy of my latest I-94 and visa both showing my correct DOB were also submitted with the I-140.

    Do any of you guys think I'll have the I-140 rejected, recieve an RFE, or will the Nebraska officer just use common sense and amend it himself? What do you reccomend I do if anything?

    Since it is 140, your attorney or you company HR can call up and get this corrected, They will give you a service number. Also they will ask for an email address after 45 days you will get an email that it will be corrected when the file is being reviewed by an officer.

If the continuous stay exceed 180 days, the foreigner should approach the concerned FRO/FRRO for registration within 30 days of the expiry of 180 days, who will in turn register them.

    Children below 16 years: As per para 2 of Registration of Foreigners (Exemption) Order, 1957, children below the age of 16 years are exempt from the requirement of registration.

    So, it seems, kids don't need to register. Common sense does prevail even in India sometimes. :D

    Hi

    I completed my 6th year H1B in April 2010 and am currently on a 7th year extension based on a pending PERM application with my current employer.

    I am currently considering taking an offer from a new employer who is willing to process my H1b transfer and my question is:

    1) Is it possible to transfer a 7th year extension to a new employer given that PERM will still be pending?

    2) If yes, will I need to give them any evidence regarding the pending PERM as I don't have any document on it except the receipt number from DOL.

    3) My current H1b expiration date is in April 2011. If the new employer files for an H1b transfer in July 2010, will I get the same H1b expiration date or a new one (i.e. July 2011)?
    This is important in my case because my wife who is currently a LPR will be eligible to become a US Citizen in June 2011 and I will likely not need to go through the PERM process.


    Any advice on the above will help a lot.

    Well you can join the new employer and they can apply for H1B Transfer. After April 2011 you can get extension or even F1 visa is useful for 1 year. After 1 year u can again come back to H1B status.
